Terms of Service

Gaia bara arts

Please read through carefully. Commissioning me means that you've read and agreed to these terms. If you have any questions about the TOS, please contact me in any of my social media accounts.

GENERAL

1. Orders will be official when the details are confirmed and the client paid for it. Full upfront payment is needed for commissions under $100 while 50% for commissions amounting to $100 or more for regular commissions. Custom commissions require full payment for orders pricing under $200 while 60% upfront for those exceeding $200.
This will be done via Paypal invoice. See more at payments

2. References are to be provided by the client. The artist will not search for themselves as the internet has vast results to show and determining which the client pertains to will be time consuming. Every detail of the desired appearance must be given reference like the pose and other things involve. Provide a mood board if possible.

3. The artist has the right to ask for more reference as needed. There is a possibility that the progress of the drawing will stop until the additional references are provided. Failure to do so will result in the object being removed from the drawing.

4. The prices given are merely starters and can change depending on any changes that may occur as the commission progresses.

5. Changes or revisions are accepted until the colored sketch. Any adjustments (even object resizing) will not be accepted beyond this point. Any color change will only be accepted IF that part is still in flat, but not anymore if it’s already rendered. (See revisions for more details)

6. Character designs or customs will add multipliers on the base character price depending on the difficulty. It is considered a custom if:
    a. The character that will be drawn does not have an initial design or clear descriptions;
    b. The character is just based from certain events or concepts;
    c. If the character is derived from an object and the client has little to no specifics on the appearance of the character; or

7. For additional objects, they are considered customs if there are no definite reference for the artist to copy. Inspirations from which the artist can derive from are not counted as this will still involve designing a new one. Objects that the artist have difficulty in drawing even with reference will be charged as well. Such objects are:
    a. Guns
    b. vehicles
    c. Vehicle parts incorporated to a character
    d. Anything that involves machine or mecha elements

8. Additional characters will lead additional fees depending on the price of the original character. The fee might increase depending on but not limited to:
    a. Size of the add'l character (headshot, half body. etc.)
    b. Complexity (Details or overall design)
    c. Complexity of pose

9. Coversations about the commission will be done via email. Final output will be sent via email three (3) days after final output approval. The client shall receive the high-res version of the artwork and any other files as necessary.

10. The client will receive updates from the artist as much as possible. Updates shall not exceed more than 2 weeks in interval.

11. As much as possible, the client will be provided a watermarked screenshot of the progress during updates.

12. COUPLE ART ISSUE - I stopped accepting in-real life couple arts because I saw a very disturbing pattern: couples that are the main subject of my work tends to break up either after the art or during. I know it might be just a crazy coincidence but i still feel bad since it happened more then 2 times. Although I won't do IRL couple art, I will still accept fictional couples, even oc x canon or self x character !!

13. In any case a commission is cancelled, BASED on the progress of the art upon cancelling, a certain amount can be requested. NO full refund will be accepted as during this time, at the very least, the sketch was done and finalized.
In cases that a full payment was done, the artist will be delighted to send back the amount of UNFINISHED progress.

14. The artist has the right to reject a commission under any circumstances.

15. Order will be added to the waitlist once prices has been agreed upon. Art progress starts once payment has been done.

PAYMENT METHODS / RULES

PAYMENT (REGULAR COMMISSIONS)

1. Payments shall be done after the details are completed and before the artist starts on any work. An invoice will be sent, at least 50% payment is expected before any progress.

2.Payments can be done either half or full upfront. Upfront full payments will be the default. If you want to do half upfront then half after art is done, please mention it to the artists, Gaia Bara, at the start of your email or upon receiving pricing. Half payments are automatically allowed via invoice for commissions priced $100 and above.

3. Payments via Paypal will be done via invoice so clients will need to provide their Paypal email. Sketch phase will start once payment is done and confirmed.

4. Payments via GCash or Paymaya must be sent by the client with the message describing the commission.

5. Finished Artwork will be sent via email if full payment is confirmed by the artist. The artist's time zone is UTC+8 so please be mindful of the time you send the payment. If the response is greatly delayed, the artist may be asleep.

6. For half upfront payments, please pay the other half via the same invoice the artist sent. Per agreement of the half upfront payment, partial payment for the invoice will be allowed.

7. Tips are non-refundable

8. Installment lower than 50-50 is okay, as long as client is fine with holding the progress until half the payment is fulfilled. Inform the artist if you need this option.

9. Please pay within 7 days after invoice was sent OR at an agreed date. You can extend up to 3 times. Failure to pay at least half of payment within these terms will lead for the commission to be cancelled.

10. Full payment shall be sent within 3 days or at an agreed date after confirmation of final piece. Failure to do so will lead to not receiving the finished piece. But you will receive art with progress corresponding to the amount paid.
NOTE: Watermark will appear on artwork during consultation until full payment is given

PAYMENT (custom COMMISSIONS)

It is hard to design characters without including the colors right from the start. Especially for cases that multiple designs must be presented (i.e. clients needing help in deciding or unsure what they want, vague ideas or no final image in mind, hence the artist shall experiment until the client is satisfied). For such cases, the following rules on payment shall apply:

1. Payment is done via invoice (Paypal) or with message if via GCash/Paymaya

2. Full payment upfront is strictly enforced. If the total cost reaches or exceeds $200, you can op for 60-40 payment. After the final design is chosen, the client must complete the rest of payment to progress to the final output and receive the files.

3. The payment shall arrive first before the artist will send the high-res image of the artwork.

4. Finalizing the design (cleaning/ rendering, etc) will halt until at least 60% of payment is fulfilled after the final design is chosen.

CUSTOM COMMISSIONS RULES/NOTES

1. 100% of the payment is expected before starting on any designing process for custom commission amounting to less than $200. The artist shall send an invoice so please pay via that invoice. If your commission qualifies for 60-40 payment, the client can pay the rest of the amount from after the final design was agreed upon until final output. No files will be sent to client if payment has not been completed yet.

2. The default final output will just be a clean colored sketch of the design. If a rendered version is desired, please refer to custom add-ons for pricing. Both the colored sketch and rendered version will be sent to the client.

3. Opting for a rendered version of the design is different from getting an illustration of the character. The colored sketch will just be rendered and the bg will either transparent, white, or the same color during concept making. If you'd like an illustration of the design with background or art with the character in a scenario, kindly refer to Character Design Bundles.

4.Add-ons for regular commissions are different from that of custom commissions. Please be guided :)

5. Item/Object/non-human designing can be commissioned on its own, without being part of a character. Please refer to Soloist, as this will have different prices from add-ons to a character design.

6. Bundles prices are based on simple character designing. Therefore, price can change depending on additional elements and complexity.

7. Client only has rights to the designs that they chose among concepts presented. They are not allowed to use the rest of the concepts that they did not chose for the final output for other [future] projects, especially with other artists. If the client desire to have a commission using the left over designs:
         a. Buy the design and order a new commission from this artist (Gaia Bara) or;
         b. Buy the design and then commission another artist for the actual project.

Revisions

The artist shall show progress every phase of the work and changes shall be discussed accordingly. The client must state any change as early as possible as there will be restrictions on revisions.

1. Overall revisions like changing the pose, the expression, clothing details, additional accessories, how the extra object appears, and others that involve line work are free of charge during sketch phase.

2. Any sort of revision during colored sketch phase, as stated in #1 shall be charged starting at $5-15 depending on the difficulty/amount. Colored sketch phase is mainly for discussion on the colors to be used.

3. Any major changes on details, poses, and the likes that involved line work will not be accepted beyond colored sketch phase.

4. Color changes during colored sketch are acceptable and free of charge.

5. Color changes beyond colored sketch will only be fine and be only accepted if the color has not been applied or has not been rendered (shaded) yet.

6. In any case that a change that will affect the line art or any nearly finished area is greatly desired, there will be a fine starting at $20-up depending on the difficulty and amount of change needed to be done.

SKETCH LIMIT VS REVISION

Sketch Limit is basically for conceptual drawings. A lot of times, descriptions can cause a number of composition ideas and to be on the safer side, the artist will draw these ideas and let the client choose their best bet. It is considered a conceptual drawing if:

1. it is a full drawing, with a character and a background which is different from the overall composition of the other sketches

2. it is a character design commission and the artist must do more clothes design and overall design on a character.

3. it is any other changes on a sketch that causes at least 50% of the overall composition to be redone.
Revision on the other hand is just small changes on a chosen sketch/composition. Or in color and lineart (if you're up for the fees) which does not change the whole composition of a sketch. Revisions are mainly accepted during sketch phase. Color changes are accepted during colored sketch phase. Any other changes beyond those phases will cause fees*
